Limitation of Liability

In no event shall SDSRT or any of its affiliates, or the officers, directors, employees, members or agents of each of them be liable for any damages of any kind, including without limitation any direct, special, incidental, indirect or consequential damages, whether or not advised of the possibility of such damages and on any theory of liability whatsoever arising out of or in connection with the use or performance of this Internet site.

Privacy Statement

This privacy statement is applicable to SDSRT's website. SDSRT does not collect personally identifiable information about individuals except when such individuals specifically provide such information on a voluntary basis. For example, such personally identifiable information may be gathered from a contest or sweepstakes registration, the registration process for member services or subscription sites or services and in connection with content submissions, community postings (e.g., chat and bulletin boards), suggestions, voting/polling activities and transactional areas. Personally identifiable information on individual users will not be sold or otherwise transferred to unaffiliated third parties without the approval of the user at the time of collection. At such points of collection, the user will have the opportunity to indicate whether she or he would like to "opt out" of receiving promotional and/or marketing information about other products, services and offerings from SDSRT and/or any third parties. Further, notwithstanding any opt out of promotional information by the user, SDSRT reserves the right to contact a subscriber regarding account status, changes to the subscriber agreement and other matters relevant to the underlying service and/or the information collected. SDSRT reserves the right to perform statistical analyses of user behavior and characteristics to measure interest in and use of the various areas of the site and to inform advertisers of such information as well as the number of users who have been exposed to or clicked on their advertising banners. SDSRT will provide only aggregated data from these analyses to third parties. Also, users should be aware that SDSRT might sometimes permit third parties to offer subscription and/or registration-based services through an SDSRT site. SDSRT is not responsible for any actions or policies of such third parties and users should check the applicable privacy policy of such party when providing personally identifiable information.

Additionally, users should be aware that when they voluntarily disclose personally identifiable information (e.g., user name, e-mail address) on the bulletin boards or in the chat areas of the SDSRT sites, that information, along with any substantive information disclosed in the user's communication, can be collected and correlated and used by third parties and may result in unsolicited messages from other posters or third parties. Such activities are beyond the control of SDSRT.

Users also should be aware that non-personal information and data might be automatically collected through the standard operation of the SDSRT Internet servers or through the use of "cookies." "Cookies" are small text files a website can use to recognize repeat users, facilitate the user's ongoing access to and use of the site and allow a site to track usage behavior and compile aggregate data that will allow content improvements and targeted advertising. Cookies are not programs that come onto a user's system and damage files. Generally, cookies work by assigning a unique number to the user that has no meaning outside the assigning site. Users should be aware that SDSRT cannot control the use of cookies or the resulting information by advertisers or third parties hosting data for SDSRT. If a user does not want information collected through the use of cookies, there is a simple procedure in most browsers that allows the user to deny or accept the cookie feature; however, users should note that cookies may be necessary to provide the user with certain features (e.g., customized delivery of information) available on the site.

SDSRT may disclose personally identifiable information about you to Third Parties as follows: (a) with your consent; (b) to facilitate a transaction or communication with a third party that the user has initiated; (c) to SDSRT's agents and advisors (such as its accountants or attorneys); (d) as SDSRT believes necessary to comply with law (including court and government orders, and civil subpoenas) or protect the rights, property, or safety of SDSRT, SDSRT website users, or others; or (e) if a user partakes (or SDSRT reasonably suspects that a user is partaking) in any illegal or potentially illegal activity.

Upon request, SDSRT will allow any user to "opt out" of further promotional contacts at any time. Additionally upon request, SDSRT will use reasonable efforts to allow users to update/correct personal information previously submitted that the user states is erroneous to the extent such activities will not compromise privacy or security interests. Also, upon a user's request, SDSRT will use commercially reasonable efforts to functionally delete the user and his or her personal information from its database; however, it may be impossible to delete a user's entry without some residual information because of backups and records of deletions.

Distribution of Member Contact Information

The South Dakota Society of Radiologic Technologists takes seriously the privacy of its members' contact information and abides by all federal and state privacy laws regarding postal addresses, telephone numbers, fax numbers and e-mail addresses. To help keep member dues as low as possible, the SDSRT may at times rent postal addresses to businesses that offer products or services that might be of interest to SDSRT members. SDSRT members consent to such rental by virtue of their membership in the SDSRT.

Member Opt-out

The SDSRT understands that some members do not wish to receive unsolicited mail, e-mail messages, faxes or telephone calls. Any member may call or write the SDSRT office and request to be placed on a list that will prevent the SDSRT from distributing the member's address, phone number, fax number or e-mail address. The SDSRT is only able to limit the receipt of mail, e-mail, faxes and telephone calls from third parties with whom SDSRT has a direct relationship. Members recognize that their individual contact information is available from other sources that SDSRT cannot control.

Mail Lists

The SDSRT rents mail lists containing members' postal addresses on a fee-per-usage basis to selected companies. In addition, SDSRT business partners may receive a mail list of member addresses as part of their negotiated contract with SDSRT. In both cases, mail list users are required to submit in advance a sample of the piece they intend to mail, which SDSRT must screen for relevancy and approve. If a company intends to send out more than one mailing using an SDSRT mail list, each individual mail piece must be submitted to the SDSRT for approval.

Affiliates and Volunteers

SDSRT affiliate societies, SDSRT volunteers, individuals and organizations that participate with SDSRT in joint projects may use contact information provided by SDSRT for SDSRT business only. These groups must ensure that all communication with SDSRT members adheres to SDSRT policies concerning content, that the originator of the content is properly identified, and that the content in no way defames or infringes upon the rights of any individual or entity.

The foregoing policies are effective as of July 13, 2007. SDSRT reserves the right to change this policy at any time without notice. Users are encouraged to review this policy from time to time.
